These Terms of Use (“Terms”) are a legally binding agreement between you (“you,” “your”) and NY Best Medical (“NY Best Medical,” “we,” “us,” or “our”) governing your access to and use of our public website located at nybestmedical.com, and related pages that link to these Terms (collectively, the “Site”).
By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy and HIPAA Notice of Privacy Practices, which is incorporated by reference. If you do not agree, do not use the Site.
These Terms apply only to the public-facing Site. Additional terms and notices may apply to our patient portal, telehealth services, or other specific programs or services.

We provide medical and occupational health services, including employment physicals and related services for agencies nationwide. The Site is provided as an informational and communication resource and is not a substitute for in-person medical care.
2. Eligibility and Use of the Site
The Site is intended for individuals 18 years of age or older who reside in the United States or its territories. By using the Site, you represent and warrant that:
- You are at least 18 years old;
- You have the legal capacity to enter into these Terms; and
- You will use the Site in compliance with these Terms and applicable law.
If you do not meet these requirements, you must not use the Site.
We may modify, suspend, or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms or applicable law.
3. No Medical Advice; No Emergency Services
3.1 Informational Purposes Only
The content on the Site is provided for general informational and educational purposes only. It may help you understand our services or general health topics, but:
- It is not medical advice;
- It is not a diagnosis or treatment plan; and

3.2 No Doctor–Patient Relationship
Use of the Site, including submitting forms, sending messages, or reading content, does not create a doctor–patient relationship between you and NY Best Medical or any of our providers. A doctor–patient relationship is only formed through appropriate in-person or telehealth encounters and documentation in accordance with applicable law and our internal policies.
3.3 Emergencies – Call 911
Do not use the Site for medical emergencies.
If you believe you are experiencing a medical emergency:
- Call 911 or your local emergency number immediately; or
- Go to the nearest emergency department or urgent care center.
Do not delay seeking emergency medical care based on information from the Site.
4. Not a Substitute for In-Person or Telehealth Care
The Site is not intended to replace:
- A physical examination or in-person visit;
- Telehealth consultations; or
- Any other professional evaluation or treatment.
Any telehealth or patient portal services provided by NY Best Medical (including through web.nybestmedical.com or other platforms) may be subject to separate terms, consent forms, or notices, which will govern your use of those services to the extent of any conflict with these Terms.
5. Your Responsibilities
You agree that you will:
- Use the Site only for lawful purposes and in accordance with these Terms;
- Provide accurate, current, and complete information when you submit forms or requests;
- Not attempt to gain unauthorized access to any part of the Site, servers, or systems;
- Not use the Site in a way that could damage, disable, overburden, or impair it, or interfere with others’ use.
You further agree not to:
- Use the Site to send, upload, or transmit any material that is unlawful, harmful, defamatory, obscene, or otherwise objectionable;
- Use any robot, scraper, or automatic device to access the Site for any purpose without our express written permission;

- You grant NY Best Medical a non-exclusive license to use such Submissions as reasonably necessary to respond to your request, provide services, and operate our practice;
- You acknowledge that email and certain web forms may not be fully secure, and you should avoid including highly sensitive information (such as Social Security numbers or detailed medical records) unless specifically requested and transmitted through a secure channel.
We do not sell your Submissions and treat personal information in accordance with our Privacy Policy and applicable law.

The Site may contain links to third-party websites, resources, or services that are not owned or controlled by NY Best Medical. These links are provided for convenience only.
We do not endorse, control, or assume responsibility for:
- The content, policies, or practices of any third-party websites; or

11. Limitation of Liability
To the maximum extent permitted by law, NY Best Medical and its owners, officers, directors, employees, contractors, agents, and affiliates shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for any loss of profits, revenue, data, or use, arising out of or related to:

If, despite the above limitations, we are found liable to you for any damages or losses arising out of or related to the Site or these Terms, our total liability shall not exceed one hundred U.S. dollars (US $100) or the amount you paid (if any) to us for using the Site, whichever is greater.

13. Governing Law and Jurisdiction
These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
You agree that any dispute, claim, or controversy arising out of or relating to the Site or these Terms shall be brought exclusively in the state or federal courts located in New York County or Kings County, New York, and you hereby submit to the personal jurisdiction of such courts and waive any objection to venue or forum non conveniens.

We may, in our sole discretion:
- Modify, update, suspend, or discontinue the Site or any part of it; and/or
- Modify or update these Terms at any time.
